Prayagraj, 02 September (HS). Allahabad High Court has acquitted former soldier Murari Lal of murder charges after 42 years. The court has cancelled the life sentence awarded to him by the sessions court after declaring him guilty of murder due to the crime not being proved beyond doubt and contradictions in the statements of witnesses.
This order has been given by the division bench of Justice Siddharth Verma and Justice R.M.N. Mishra after hearing the arguments of Murari's senior advocate. It is known that Phool Singh was murdered on 06 July 1982 when he was coming to his village Wazirganj. His brother Shivdan Singh lodged an FIR and accused Murari Lal of murdering him by firing a bullet due to enmity. The Sessions Court of Badaun convicted him and sentenced him to life imprisonment. At present the accused is on bail.
The court said that the site plan is faulty, it is not clear whether Phool Singh was killed while coming to the village or while going to the village. The statement of the only eyewitness is not reliable because no witness supported his statement. The person who signed the Panchayatnama has denied that he did not sign. Someone said that the dead body was taken to the police station while someone said that the dead body was not taken to the police station.
Due to the various failures of the prosecution, the court considered the charge of murder against the accused appellant as doubtful and cancelled the sentence. The court said that the accused is on bail, so there is no need for him to surrender. Take action as per the rules.
