According to sources, the Law Commission may recommend adding a new chapter on 'One Nation, One Election' in the Constitution and strengthening a democratic process of holding Lok Sabha, State Legislature and local level elections across the country by mid-2029.
The commission headed by Justice (retd) Ruturaj Awasthi will recommend an amendment to the Constitution to add 'a new chapter or section' on joint elections, sources said. The Commission will also recommend consolidating the terms of Legislative Assemblies in three phases over the next five years, so that for the first time combined elections across the country can be held in May-June, 2029, along with the elections to the 19th Lok Sabha.
Sources said the new chapter of the Constitution will include issues related to 'consolidated elections', 'sustainability of consolidated elections' and 'one electoral roll' for the Lok Sabha, state assemblies, panchayats and municipalities, so that three-tier elections can be held. Can occur simultaneously. The new chapter being recommended will provide power to repeal other articles of the Constitution relating to the tenure of legislative assemblies.
The five-year period in which the tenure of the Legislative Assemblies will be limited will have three phases. The Commission will recommend that the first round will be for those assemblies whose tenure will be reduced by three or six months. If a government falls due to a no-confidence vote or a hung assembly is formed, the Commission will recommend the formation of a 'unity government' comprising representatives of different political parties. If the principle of 'unity government' does not work, the Law Commission will recommend fresh elections for the remaining term of the House. Considering that fresh elections are needed and the government still has three years left, elections should be held for the remaining term to ensure stability, a source said.
Apart from the Law Commission, a high-level committee headed by former President Ram Nath Kovind is also working on a report on how elections to the Lok Sabha, state assemblies, municipalities and panchayats can be conducted by changing the Constitution and the existing legal framework. . .Can be done together.
