Prayagraj, 18 October (Hindustan Reporter). Allahabad High Court rejected the election petition filed by Vijay Nandan against Prime Minister Narendra Modi's Varanasi Lok Sabha elections.
The court refused to hear the election petition, terming it time barred because it was filed after the expiry of the 45-day deadline. This order has been given by Justice Soumitra Dayal Singh. The election petition was presented on September 3. Filing was done 19 days late from the stipulated period.
There is no provision for condonation of delay in filing the petition in the Representation of the People Act. There is a provision for hearing the election petition only if it is filed within the deadline of 45 days. The court had asked the petitioner whether he wanted to take time on this aspect. The petitioner had asked for time. On this, the court had directed to list the petition on October 18.
According to the petition, the District Election Officer had rejected the nomination of Vijay Nandan. Vijay Nandan, a resident of Seoni district of Madhya Pradesh, associated with the Janhit Party, says that the returning officer had wrongly rejected his nomination.
In the election petition, there was a demand to cancel the election of Prime Minister Narendra Modi and declare the nomination of the petitioner valid and hold re-election on Varanasi seat.
