New Delhi: The Supreme Court termed the ED’s attitude as arbitrary and inhuman during the nearly 15-hour interrogation of former Haryana Congress MLA Surendra Panwar. Apart from this, the decision declaring the arrest of the Congress leader illegal has been considered correct.
A bench of Justices Abhay S Oka and Augustine George Masih said the behavior of the ED officials was inhumane as the case was not related to any terrorist activity but to illegal sand mining.
The bench said that people should not be treated like this in such cases. You have forced a person to give a statement.
Rejecting ED’s petition against the Supreme Court order, the bench said that we do not want to interfere with the High Court order in which it was said that the arrest of the accused was illegal.
The bench said the high court’s finding was only to decide whether Panwar’s arrest was illegal or not.
The bench, in its December 2 order, said the decision will not affect the merits of the belated complaint under Section 44 of the PMLA, 2002.
The court said that the attitude of ED in the investigation is shocking under which a person was forced to give a statement.
ED lawyer Zohab Hussain said that the High Court has wrongly concluded that Panwar was interrogated continuously for 14 hours and 40 minutes. During questioning he pointed towards the dinner break.
