ED's constitutional duty to dispose of cases expeditiously: Special court

Mumbai: A special court granted bail to two accused in the Cox and Kings case, saying it is the constitutional responsibility of the Enforcement Directorate (ED) to ensure that the case is tried expeditiously. On Tuesday, the court granted bail to CFO Anil Khandelwal and internal auditor Naresh Jain. Both have spent three years in jail in this case.

He has spent more than three and a half years in jail since his arrest in October 2020. It was argued in the petition that according to the law, people who have served more than half the maximum sentence can be released on bail.

The court said that his right to a speedy trial could not be denied and the trial was not delayed because of him. ED's constitutional duty to expedite trials has been violated several times. According to the Prevention of Money Laundering Act, if the original offense has not been produced before the court and the trial of that case and the ED case are not going on simultaneously, then the trial of the case by ED cannot commence. . At present, both the petitioners have served more than the minimum sentence of three years in jail. Therefore, without framing of charges or trial, both are guilty. Despite this situation, ED wants to keep him in jail indefinitely. Special Judge Deshpande said, the functioning of such ED is a matter of concern.

It is alleged that this amount is related to the loan given by Yes Bank to the company and later the accused have embezzled it.
