New Delhi, 01 April (HS). Delhi High Court has directed ED to file a note before the Special Judge on the matter of issuing orders during the ED custody of Delhi Chief Minister Arvind Kejriwal. A bench headed by Acting Chief Justice Manmohan gave this order while disposing of a petition seeking to restrain Kejriwal from issuing any order from ED custody.
During the hearing, the lawyer appearing for ED said that ED had not provided any such infrastructure to Kejriwal so that he could issue any order. During the hearing, the lawyer appearing for Kejriwal raised questions on the jurisdiction of this petition and said that the ED is sufficient in dealing with this case. The petition was filed by Surjeet Singh Yadav.
The petition demanded that typist, computer printer etc. should not be provided to Arvind Kejriwal during ED custody. The petition demanded that the ED be directed to investigate how the instructions issued by Arvind Kejriwal reached Delhi Minister Atishi during his detention. In the petition, it was feared that the instructions issued by Kejriwal were intended to influence the investigation. The investigation must be independent and impartial for the rule of law to prevail.
It was said in the petition that the instructions issued by Arvind Kejriwal in ED custody are a violation of the oath of secrecy. Doing so is a violation of the Third Schedule of the Constitution.
Let us tell you that today Rouse Avenue Court sent Kejriwal to judicial custody till April 15.
