Dispute or attack without intention to insult will not fall under the category of SC-ST Act offence: High Court


Ranchi, 19 February (HS). Jharkhand High Court, while hearing a case, has accepted that unless there is a dispute or attack with the intention of insulting a person belonging to Scheduled Caste or Tribe, then that crime will not be covered under the SC-ST Act. Will not be considered.

In fact, Dumka Civil Court had convicted Baijnath Singh and Naved Singh in the SC-ST case and sentenced them to two years' imprisonment, against which a petition was filed in the High Court. On Monday, the petition of the convicts was heard in the court of Judge Gautam Kumar Chaudhary.

During the hearing, the court said that deliberate display of insult or intimidation with intent to publicly humiliate a member of a Scheduled Caste or a Scheduled Tribe constitutes an offense under Section 3(1)(x) of the SC-ST Act. Is necessary. In no case does it constitute an offense under the SC/ST Act unless it is specifically intended to humiliate the victim on the basis of his or her caste.
