The accused was identified as Nityanand Sarkar, originally from West Bengal. who described the brutality of the act He lived alone in Nithari, Noida. His wife and two children live in West Bengal. A case has been registered against him under Section 65(2), Section 5F, Section 5M of the Indian Judicial Code i.e. BNS and Section 6 of POCSO.
Prosecution officer POCSO advocate JP Bhati said that the sections of the case are serious. Section 65(2) has been imposed since the girl is below 12 years of age. It is clear from the imposition of Section 5F and Section 5M of POCSO that the accused has molested the girl many times in the past.
According to Section 5M of POCSO, he raped the girl by showing her obscene videos. Section 6 of POCSO has been imposed in this case. This shows that Noida Police will try to present an effective defense in this case and either get the death penalty for the accused or keep him in jail till his last breath.
Remaining calm after sending the accused to jail
Police say that they have denied getting any footage related to the incident. Police have denied receiving any CCTV footage of the incident from the school. Regarding action against the school management, the DCP says that no action has been taken against the school.
If negligence is found during investigation, action will be taken. At the same time, the police has maintained silence after registering the case. Even after five days of the incident, no investigation has been done by visiting the school. Besides, the police station has also denied that the accused has any criminal history.
