Delhi: Section 6A of Citizenship Act constitutionally valid: Supreme Court

The Supreme Court on Thursday upheld the constitutionality of Section 6A of the Citizenship Act, CJI D.Y. A five-judge constitution bench headed by Chandrachud gave its verdict in this case.

Apart from the CJI, the bench also includes Justice Surya Kant, Justice M.M. were also included. Sundaresh, Justice J.B. Pardiwala and Justice Manoj Mishra, whose bench delivered the verdict by a divided vote of 4 to 1. Four judges, including CJI Chandrachud, agreed, while Justice Pardiwala dissented. The benefit of citizenship granted to illegal immigrants in Assam between 1 January 1966 and 25 March 1971 will be admissible under this section. However, foreigners who came to Assam after March 25, 1971 will not be eligible for Indian citizenship.

Include Bangladeshis in NRC: Court

The Supreme Court had directed the Central and state governments to separately identify illegal Bangladeshi tourists and include them in the NRC under the then Sarbananda Sonowal government for staying in Assam. The Supreme Court will now monitor their identity and residence operations.

Assam challenges validity of Article 6A

The Assam government's petition challenged the constitutionality of Section 6A of the Act, saying that the influx of Bangladeshi refugees into India has affected the population balance in Assam. Article 6A violates the rights of the original inhabitants of the state.
