New Delhi, 13 December (HS). Tahir Hussain has filed a fresh bail petition in Karkardooma Court in the case of conspiracy to commit Delhi riots. The court has issued a notice to Delhi Police while hearing the bail petition. The next hearing on the bail plea will be on December 19.
In the new bail petition, Tahir Hussain has said that the court had rejected his bail petition on March 30, 2024. Since then nine more months have passed in custody. It has been said in the petition that till now he has spent 4 years and 8 months in custody. Arguments are currently being held on framing of charges in this case. In this case, the High Court has currently banned issuing any order on framing of charges. In such a situation, it will take a lot of time to frame the charges. It has been said in the petition that his name is not in the FIR and he has been made an accused only on the basis of the disclosure statement. Disclosure statement is not recognized under Section 25 of the Indian Evidence Act 1972.
During the hearing on framing of charges in this case, Tahir Hussain had said that his WhatsApp chat had not incited the people of Delhi to violence. In the WhatsApp chats on which Delhi Police is basing it, nowhere did it ask people to take up arms against the government. In the WhatsApp chat, people were asked to protest peacefully. Tahir Hussain’s lawyer had told the court that Chakka Jam is not a terrorist activity. Criticizing government policies does not amount to opposing the country unless it poses a threat to the unity, integrity and security of the country.
An FIR was registered on March 6, 2020 in connection with the conspiracy of Delhi riots. After that, till now one charge sheet and four supplementary charge sheets have been filed. In this case, charge sheet has been filed against 18 accused including Umar Khalid in the case registered under UAPA.
