New Delhi, 07 March (Hindustan Reporter). The Delhi High Court has reprimanded the Delhi Police for beating up five Muslim youths for forcing them to sing the national anthem during the violence in North-East Delhi, saying that it cannot wait long for the forensic report. . The bench of Justice Anup Jairam Bhambhani ordered an in-chamber hearing in this case on April 3.
During the hearing, the lawyer appearing for Delhi Police said that the forensic report of some video footage is yet to come from National Forensic Science University, Gujarat. Expressing displeasure on this, the court said that the court can stop the ongoing forensic investigation in Gujarat. The court cannot wait endlessly for the forensic report. Some time should be fixed for this. The forensic report has been awaited for the last ten months, when will this wait end? First the forensic report was awaited from Delhi and now from Gujarat.
Earlier, the court had reprimanded the Delhi Police for its poor investigation in identifying and investigating the policemen who beat up the Muslim youth. The court had said that how the number of injuries in the post-mortem report of the deceased youth increased compared to the number of injuries recorded in the MLC made at the time of detention. During the hearing, the court had said that the status report of this case has neither been filed in the court nor is with the police. The court had said that there were many inaccuracies in the police investigation report. Of the five youths, one died but four are alive. Were those policemen identified from the surviving youth? You will investigate the whole world but will not interrogate the eyewitnesses. You did not even bother to record the statements of those four youths. What kind of investigation is this?
Actually, a video titled Jana-Gana-Mana had gone viral on social media, in which policemen are surrounding five Muslim youths and are pressurizing them to sing the national anthem. These youths are lying helplessly on the ground and the police are beating them. A young man named Faizan was arrested by the police on 24 February 2020 and was released in a very critical condition on 25 February 2020. He was admitted to LNJP Hospital, where he died on 26 February 2020.
The petition has been filed by Faizan's mother. The petition states that on the intervening night of 25-26 February 2020, Faizan had told his mother Kismatun that he was tortured by the police and beaten badly. The petition states that Faizan was kept in illegal detention at Jyoti Nagar police station and was denied medical treatment. When his condition started deteriorating and the police felt that he would not survive, he was released.
It has been said in the petition that a case of murder has been registered in this matter but efforts are being made to save the policemen in the investigation. In such a situation, this matter should be investigated under the supervision of the court. For this, an independent and impartial team should be formed to investigate the custodial death of Faizan. Guidelines should be issued to file the report of this investigation in the court from time to time.
