In June 2022, the Supreme Court referred to the murder case of tailor Kanaiyalal, who was taken hostage by jihadi elements inside a shop in Udaipur, Rajasthan. The Supreme Court said this while hearing a PIL, which sought a stop to the increasing mob lynching against the minority community, including killings by cow vigilantes, as well as providing interim financial assistance to the families of victims of such violence. Justice B.R. Gavai, Justice Arvind Kumar and Justice Sandeep Mehta, while referring to the murder of Kanaiyalal, asked the petitioner's counsel not to be selective while presenting such cases.
The Supreme Court asked the lawyer, what about the tailor Kanaiyalal of Rajasthan? In response to which lawyer Nizam Pasha admitted that yes, there was no mention of this in the application. The court said that when all the states are there, you cannot be selective. Kanaiyalal was brutally murdered for posting in support of former BJP spokesperson Nupur Sharma. After which the lawyer appearing for Gujarat in the case said that this PIL only highlights the incidents of lynching of Muslims. Senior lawyer Archana Pathak Dave said that this is only a case of mob lynching of Muslims. He questioned how it could be so selective. The state must protect people of all communities. After which the court said that if this is a matter of all the states. Yes, you should make sure it is not selective. Against which lawyer Pasha argued that only Muslims have been killed in this way and this is a fact. Justice Gavai, against Jain, said, please be careful in your presentation before the court. The court has postponed the hearing on this PIL till after the summer vacation.
