Delhi: Judges are not only under political pressure: Retired CJI

Retired CJI Justice DY Chandrachud has said that there is not only political pressure on judges. They are also under pressure from private interest groups. These private interest groups create the environment with the help of news, TV and social media. They carry out publicity which puts pressure on the judge to give a particular decision.

Even trolling is done to bring such pressure. Attacks are carried out through social media. The retired CJI also said that how many judgments against the government should not be the only yardstick to measure the independence of the judiciary? He was speaking in an English newspaper programme. He also explained about his decision and said that I think I have tried to strike a balance. I have always given decisions based on my judicial understanding and not influenced by any particular consideration.

He also said that the CJI as well as the Chief Justice of all high courts need to work with the government on the administrative side. He also recalled the reforms he had undertaken regarding judicial infrastructure and government funds and noted the differences between the Supreme Court collegium and the government, which remained in debate. Retired CJI Chandrachud also said that all differences cannot be resolved. The best example of this is that the government is still not happy with the appointment of lawyer Saurabh Kirpal as High Court judge. A judge's sexuality or whether his partner is a foreign national should not affect his decision.
