New Delhi: Delhi Chief Minister Arvind Kejriwal, who is lodged in Tihar Jail on the issue of Delhi Excise Policy scam, has challenged the High Court's decision to stay his bail in the Supreme Court. While hearing Kejriwal's petition, the Supreme Court said that either withdraw the petition you have filed in the High Court or wait for the final decision of the High Court, we will not interfere till then. At present, Kejriwal has not got any relief in this case in the Supreme Court.
During the hearing, the petitioner told the bench of Justice Manoj Mishra and Justice SVN Bhatti that the High Court is not hearing his petition because a similar case is pending in the Supreme Court. While hearing the case, the Supreme Court said that first withdraw your petition from the High Court and then come to us. Now the Supreme Court will hear this case on Wednesday. By then the final decision of the High Court on the stay on Kejriwal's bail will also come.
The Supreme Court said that the High Court has reserved its decision, so it is not appropriate for us to interfere in any way. We will now hear the matter on Wednesday. Kejriwal's lawyer Abhishek Singhvi said that if the High Court can stay the copy of the order before it is uploaded, then the Supreme Court can also stay it before the High Court order comes. Later, Supreme Court Justice Manoj Mishra said that generally the decision is not reserved in stay cases and it has to be settled immediately. What happened in this case is unusual. Kejriwal was arrested by the ED on March 21, Kejriwal was recently released on bail by the lower court, however before his release, the High Court stayed the bail and reserved the final decision. Kejriwal has appealed to the Supreme Court against the stay.
On the other hand, the final decision is yet to come in the High Court. In such a situation, the final decision on Kejriwal's bail can come in two to three days.
