The hearing on Chief Minister Arvind Kejriwal's petition challenging the CBI's order of arrest and remand in a corruption case related to the Delhi excise policy scam was completed in the Delhi High Court on Wednesday and Kejriwal's bail was secured. The Delhi High Court has now ordered a re-hearing on July 29. Sindhvi has argued that the CBI has no evidence against Arvind Kejriwal.
Kejriwal is chief minister, not a terrorist: Singhvi
Abhishek Manu Singhvi asked the CBI what it was doing for a year, why did the investigating agency not arrest Arvind Kejriwal? Singhvi called Arvind Kejriwal's arrest illegal. He said that Kejriwal deserves complete immunity. Arvind Kejriwal is the Chief Minister, not a terrorist who should not get bail.
Why did Singhvi mention the order of Justice Sanjiv Khanna?
Abhishek Manu Singhvi said that my arrest in this case is a violation of the fundamental rights given under Articles 14, 21, 22 of the Constitution. Meanwhile, the CBI filed an application in the trial court for its first interrogation, but the trial court did not deem it necessary to issue a notice to Arvind Kejriwal. The only reason given by the CBI to the trial court for my arrest was that I was not giving satisfactory answers to their questions. Can I be arrested for not giving the answers expected by the investigating agency? How can this be a basis in itself? It is wrong for the trial court to allow my arrest. Recently, Justice Sanjeev Khanna said in his order that mere interrogation cannot be the basis for arrest.
There is no need to arrest Kejriwal: Singhvi
However, the Supreme Court granted me interim bail in the ED case. But due to this insurance arrest, he could not come out. They want to keep Kejriwal in jail at any cost. After 2 years, Arvind Kejriwal was suddenly arrested. The CBI could not explain why the arrest was made. The dates show that there was no need for the arrest. It was only a rebellious arrest. The rules of law have been violated in this case.
Why did the CBI not do anything for one year? Singhvi's question
Abhishek Manu Singhvi, on behalf of Arvind Kejriwal, said that the CBI never called me before March 21, 2024. After which I was arrested by the ED. This is the rarest of rare cases because for a year the CBI did nothing against me. The Supreme Court has granted me bail. On the orders of the court, I went back to Tihar Jail on June 2. There is no basis for the arrest made by the CBI in this case. The lower court granted me bail in the ED case. After which I was produced before the vacation judge. On June 26, the CBI became active and Kejriwal was arrested.
At the last hearing, Justice Neena Bansal Krishna's bench had sent a notice to the CBI and directed it to file a reply. During the hearing, senior advocate Abhishek Manu Singhvi said that this is the first time he has come to serve a notice. There was no question of the CBI arresting me in June because the CBI FIR is of August 2022. He also said that the CBI has no reason for the arrest. The arrest and subsequent remand order has been challenged by Chief Minister Arvind Kejriwal.
