What was said in the application?
It is worth noting that the Central Government had issued a notification to celebrate 25th June as Constitution Hatya Diwas. A person named Sameer Malik filed a PIL in the Delhi High Court against this order of the Center. In this petition, the notification of the Central Government was challenged. In this petition, it was said that the then Indira Gandhi government had declared emergency under Article 352 of the Constitution. Therefore, it cannot be said that this was done by killing the Constitution.
Delhi HC dismisses plea
A bench of Chief Justice Manmohan and Justice Tushar Rao Gadella heard the case. The court said that the notification of the Central Government is against the misuse of power and misuse of constitutional provisions. The High Court admitted that the notification of the Central Government did not violate the Constitution. The court has given a big relief to the Central Government by dismissing this petition.
The notification was issued on July 13
Let us tell you that for this the central government had issued a notification on July 13. It has been said in the notification that by imposing emergency on 25 June 1975, the then government had grossly violated the rights of the people. Emergency was imposed in the country on 25 June 1975 by the then Indira Gandhi government.
