Delay in giving possession of apartment to customer, Raheja Developers fined Rs 1 lakh

Jaipur, June 15 (HS). District Consumer Commission, Jaipur-I has imposed a fine of Rs 1 lakh on the opposite party M/s Raheja Developers and M/s Raheja Navodaya Apartment Owners Association Gurgaon, Haryana, considering it a service defect to delay giving possession of the apartment to the customer by violating the terms of the sales contract. At the same time, the opposite party developers have been directed to pay 6 percent annual interest to the complainant on the amount deposited by December 1, 2016 till the date of giving possession of the apartment i.e. January 23, 2021. Commission Chairman Dr. Sube Singh Yadav and member Neelam Sharma gave this order on the complaint of Aastha Gupta and others.

It was said in the complaint that in December 2011, he contacted the opponent to buy an apartment in Raheja Sampada Towers, a residential scheme in Gurugram. Later, on 23 December 2011, an apartment sale contract was signed between them. The opponent was to give possession of the apartment in 36 months. The complainant also took a loan of Rs 25 lakh from the bank to buy the apartment. He paid the full amount of the apartment by December 2016, but the opponent developers gave him possession in January 2021. The complainant challenged this in the Consumer Commission and requested for compensation and interest on the deposit amount from the opponent for delay in giving possession of the apartment. The Consumer Commission admitted that the opponent has delayed giving possession of the apartment to the complainant by disregarding the terms of the contract. In such a situation, it would be appropriate to impose a penalty on him. At the same time, the Commission has also directed to pay interest for the period of delay on the deposit amount.
