When the matter reached the High Court, the court investigated all the clues and asked the SP of Kushinagar whether a dead person or even a ghost can implicate an innocent person by filing an FIR? It is known that in this case, in the year 2014, a dead person had lodged an FIR against five members of the same family in a land case and the investigating officer investigating the case had also recorded the statement. Then his charge sheet was also filed. When the matter came to the trial court, the court considered the matter. When the matter came to the Allahabad High Court, the court canceled the case after hearing and asked the SP to investigate how a ghost can implicate an innocent person.

That the accused Purushottam Singh, who lives in Hata police station area of Kushinagar, along with his two brothers and two sons, had challenged the chargesheet filed by the police in the Allahabad High Court. The court of Justice Saurabh Shyam Samseri was told that in 2014, a person named Shadaprakash had lodged an FIR of fraud against Purushottam and others. Whereas Shadaprakash had died in 2011 itself.
The statement was corrected
Advocate Rajesh Kumar argued that the accused had an old land dispute with the deceased Shadprakash and even after the death of the plaintiff Shabprakash, the investigating officer of the case recorded his statement and filed a chargesheet against all of them. The advocate also attached the death certificate issued by Mamta, wife of the deceased Shadprakash.
Signed by a ghost?
The court was also stunned to know the case and questioned whether Bhut had filed the FIR in 2014 when the plaintiff Shabprakash died in 2011 and whether the investigating officer filed the chargesheet by taking Bhut's statement and whether Bhut himself filed the chargesheet in the High Court in 2023. The court signed the petition itself?
While hearing the entire case, the court cancelled the chargesheet framed against the accused Purushottam Singh and his family and ordered the SP Kushinagar to investigate. It said that how can a ghost harass innocent people by filing cases against them. It also asked the SP to explain how the investigators took the statement of the ghost?
Expressing strong displeasure in this matter, the court has asked the President of the Bar Association to attach a copy of this order and advise the lawyer who filed the Power of Attorney without the statement of the deceased plaintiff to be careful in future.
