Prayagraj, 23 September (HS). Allahabad High Court has said that acquittal in departmental proceedings cannot be the basis for cancelling criminal case proceedings. After framing of charges and examination of witnesses in the trial, the accused can be acquitted. But criminal proceedings cannot be ended.
The court has rejected the petition of Govindpura, Ghaziabad post office fraud accused Subhan Ali. The petitioner was acquitted in the departmental inquiry because the allegations were against the rules or were not applicable. On this basis, he had filed a petition in the High Court to cancel the criminal proceedings. This order has been given by Justice Samit Gopal on the petition of Subhan Ali.
It is known that a complaint was received in Ghaziabad's CBI police station on 13 January 17 on charges of conspiracy, corruption, fraud etc. In which money was transferred in Govindpura Post Office and Ghaziabad Head Post Office in 2015 with fake documents. While the account was closed. On 15 October 20, CBI filed a charge sheet against eight accused. CBI Court Ghaziabad took cognizance and issued summons. Four witnesses have been examined in the trial. After being acquitted on technical grounds without proving the charges in the departmental investigation, a petition was filed saying that the criminal case should be ended.
CBI said that once the charges are framed and the trial begins, the accused cannot be discharged in the middle without determining the merits and demerits. He can be acquitted only if he is not proven guilty in the trial. A criminal case cannot be closed on the basis of acquittal in a departmental inquiry.
