Mumbai – The Thane Motor Accident Claims Tribunal has ordered the Maharashtra State Road Transport Corporation to pay compensation of Rs 30.94 lakh to the family of a delivery executive who met with a road accident in the year 2020.
The tribunal said there was oral and documentary evidence that the negligence of the MSRTC driver was responsible for the accident.
Mangesh Goregaonkar, a resident of Dhobighat area of Mumbai, was traveling in an ecocar with four friends on the Goa Mumbai Highway on January 19, 2020. Then a bus ran in the opposite direction near Karnali. The speeding bus crossed the divider and entered the wrong lane and collided with the eco car. All the passengers in the car died.
In Goregaonkar’s family, family members applied for compensation for the mother, wife, two children and mentally challenged brother. MSRTC offered its defense that the car was at fault by the driver.
The tribunal rejected MSRTC’s defence. MACT member SN Shah said that from the damage to the vehicles and the details of the accident site, it is clear that the front part of the car has been destroyed due to the collision with the bus. The accident happened at four in the evening and there was adequate light on the road. The bus driver’s seat is high and he gets a clear view of the road and oncoming traffic. The tribunal said it was still possible for the driver of the ST to avoid the accident.
