Prayagraj, 01 July (HS). Allahabad High Court has given a big relief to the family members in the case filed by the wife against the entire family on the charges of dowry harassment and assault after the husband filed a divorce case. The criminal case going on in the court of Judicial Magistrate Meerut against seven members of the family including men and women has been cancelled, but the case against the husband has been refused to be cancelled.
The court said that he should surrender in the court within four weeks and file a bail application and directed the magistrate to decide the matter as early as possible. The court said that the allegation on the family of demanding five lakh cash and a Bolero car after five years of marriage is of general nature. Therefore, no case will be filed against the family members. But the case will be filed on the basis of the charge sheet filed against the husband on the charges of dowry harassment and assault. The court has dismissed the case against the accused family members Mrs. Rasida, Rashid, Kari Sajid, Khadija, Maulana, Muhammadi, Ummehani.
This order was given by Justice Saurabh Shyam Shamshery while partially accepting the petition filed by Mohammad Ashraf and 7 others challenging the validity of the criminal case.
It is known that the petitioner and the opponent got married on 30 March 17. They also had two children. Due to family discord, the wife left the house and came to her maternal home. The husband kept the children with himself. He did not give them even when asked. On which the wife lodged an FIR on 25 February 23 in Mundali police station on the charges of dowry harassment and assault. In which the court took cognizance of the police charge sheet and issued summons. The charge sheet and summons order along with the case proceedings were challenged.
The petitioner's husband said that he had filed a divorce case on 19 October 22. The dowry harassment case has been filed to put pressure. And the whole family has been accused. The dowry allegation is false. Therefore, the case should be cancelled. On which the court has given relief to the family but has ordered to file a case against the husband.
