Bombay High Court declares IT rules unconstitutional, rules formally struck down after third judge's ruling | News India

Mumbai : Following the third judge's decision, the Bombay High Court formally struck down the amended Information Technology (IT) rules and declared them unconstitutional. Information Technology Rules were introduced to identify and regulate fake and false content against the government on internet media.

On September 20, Justice AS Chandurkar had said that being vague and broad, the amended rules could adversely impact not only individuals but also internet media companies. In fact, earlier this year, the bench of Justice Gautam Patel (now retired) and Justice Neela Gokhale had given a divided verdict in this case. After this the case was handed over to Justice Chandurkar as the tie breaker judge. After their decision, on Thursday the bench of Justices AS Gadkari and Neela Gokhale formally gave the verdict in this case. The Court said that following the advice of the majority, Rule 3(1)(V) is declared unconstitutional and set aside.
