A three-judge bench of the Supreme Court, comprising Justice Sanjiv Khanna, Justice Dipankar Dutta and Justice PB Varale, was hearing the case. The bench asked the ED, what is the need to still keep Sanjay Singh in jail? The court told Sanjay Singh's lawyer that money laundering has not been confirmed and the money trail has also not been detected yet. However, Sanjay Singh has been in jail for 6 months.
The Supreme Court also heard Sanjay Singh's petition challenging his arrest and remand in the money laundering case. The Supreme Court bench accepted the argument of the AAP MP's lawyer that no money was recovered from Sanjay Singh and the allegations of taking a bribe of Rs 2 crore against him can be investigated.
ED had arrested Sanjay Singh on October 4 last. ED had opposed the bail application of AAP MP in the High Court. Sanjay Singh sought bail on the grounds that he has been in custody for more than three months and I have no role in the crime. The investigating agency opposed the bail plea in the high court and claimed that Sanjay Singh was involved in keeping, concealing and using funds received from the Delhi Liquor Policy related to the policy period 2021-22. However, the agency did not oppose his bail in the Supreme Court.
