New Delhi, May 29 (HS). Bibhav Kumar, accused of assaulting Aam Aadmi Party's Rajya Sabha member Swati Maliwal, has challenged his arrest in the Delhi High Court. Bibhav Kumar has called his arrest illegal and demanded compensation.
On May 28, the Tis Hazari court had ordered Bibhav Kumar to be sent to police custody for three days. On May 27, the court had rejected Bibhav Kumar's bail plea. During the hearing, Atul Shrivastava, the lawyer representing Delhi Police, had said that Swati herself had clarified in the FIR why she delayed in approaching the police. She was in trauma after the incident, which is why there was a delay. Bibhav's lawyer had said that the CCTV footage does not confirm the assault on Swati Maliwal. He had said that if it is taking three days to even file a complaint with the police, then it is clear that Swati was plotting during this time.
Bibhav Kumar is currently in police custody. In this case, Swati Maliwal had recorded her statement in the court on May 17. The incident took place on May 13. Delhi Police had recorded Swati Maliwal's statement on May 16 and filed an FIR.
