Dalit and tribal organizations have called for a Bharat Bandh on Wednesday. This Bharat Bandh has been called in protest against the Supreme Court's decision to implement reservation in Scheduled Castes and Tribes. The National Confederation of Dalit and Tribal Organizations has demanded the central government to cancel the Supreme Court's decision against the constitutional rights of Dalits and tribals.

Can anyone announce a Bharat Bandh?

India is a democratic country and here everyone has the right to express their views. Under Article 19 of the Indian Constitution, citizens get many rights. Article 19 gives Indians the right to freedom of speech and expression. Whereas under Section B, people can gather peacefully anywhere without weapons. In such a situation, the organization can declare Bharat Bandh in the country.

What does the law say on demonstrations?

The Indian Constitution allows peaceful protests, but it does not include weapons. Action begins when the protest turns violent. Different cases of violence have been registered under different sections. The punishment for this also varies. For example, if a protester involved in Bharat Bandh damages someone's property, such cases are dealt with under the Public Property Damage Prevention Act, 1984. According to this law, the person damaging public property will be punished with five years of imprisonment and fine. Most such cases come to light when protests turn violent.

The country's highest court, the Supreme Court, took the initiative to reform this law and formed a committee in the year 2007. Justice Thomas Committee and the second Nariman Committee, but the matter was not very effective. After this, seeing the number of riots and demonstrations, the Supreme Court also talked about forming a tribunal so that recovery can be made from the rioters or the leaders of the protesters who damage public property. However, this process could not reach its final result.

In such a situation, when there was a protest in UP regarding CAA, the Yogi government brought a law on it. Which was called UP Public and Private Property Damage Compensation Act 2020. That if property is damaged due to a violent mob, then public property will also have to be compensated. Thus, in a democratic country like India, there can be peaceful protests and shutdowns, but there is also a provision for action if they turn violent.
