Bailable warrant issued against Director Secondary Education, Joint Director Education Varanasi, DIOS Jaunpur and others

Prayagraj, 08 July (HS). Allahabad High Court has issued a bailable warrant against the Director of Secondary Education Prayagraj, Joint Director of Education Varanasi, DIOS Jaunpur, Finance and Account Officer District School Inspector Office Jaunpur and Manager of Intermediate College Nevariya Jaunpur for not filing a reply despite the order in the salary case of an Inter College teacher.

This order has been passed by Justice Subhash Vidyarthi on the petition of Bajrangbali Dubey. The court was told that the petitioner had filed a petition in 2010, on which a reply was sought from all these opposing parties. But they have not filed a reply affidavit till now. On this, the court had ordered all of them to file a reply by July 5 or appear personally with the complete record. But neither the parties appeared nor their advocates and no reply was filed. Expressing displeasure over this, the court has issued a bailable warrant to ensure the presence of all these officials.
The petitioner was appointed by the management committee of Inter College Nevariya Jaunpur in 1995. After that the manager wrote a letter to the DIOS for approval of the appointment but the DIOS did not issue the approval order even after a week. Due to which the management assumed that the petitioner's appointment has been approved.

DIOS also approved the salary in 1999 but the petitioner was not getting the salary. The petitioner gave several representations, even after that he did not get the salary, so he filed a petition. The High Court directed the DIOS to dispose of the petitioner's representation soon. DIOS rejected the petitioner's representation saying that the petitioner was not appointed as LT grade Assistant Teacher but as CT grade Assistant Teacher. Whereas CT grade has been declared a dying cadre.

The DIOS said that the petitioner has been appointed by the management against a basically vacant post. The right to appoint against a basically vacant post lies with the Uttar Pradesh Secondary Education Service Selection Board. Therefore, since the appointment of the petitioner by the management is against the law, paying the salary from the salary payment account is not legal. The next hearing on the petition will be on July 19.
