Balodabazar/Raipur, September 10 (HS). The CJM Court of Balodabazar on Tuesday rejected the bail plea of Congress MLA Devendra Yadav who was arrested in the Balodabazar arson and violence case. The court said that this court does not have the power to release the accused on bail.
It is to be noted that Baloda Bazaar police have registered an FIR against Devendra Yadav in CT Kotwali under sections 153A, 501(1), 505(1)(B), 501(1)(C), 109, 120 B, 147, 148, 149, 186, 353, 332, 333, 307, 435, 436, 341, 427 of IPC and sections 03, 04 of the Public Property Damage Prevention Act, 1984.
On Monday, MLA Yadav's lawyer Anadi Shankar Mishra argued in court that police has presented challan in 12 out of 13 cases registered in Baloda Bazar violence, vandalism and arson case and they are deliberately delaying presenting challan in this one case against the MLA only due to political animosity. He said that police does not have any evidence and proof against MLA Yadav. By delaying in this case, only evidence and proof is being fabricated against the MLA. After hearing the bail plea on Monday, the court reserved the decision.
After issuing notices several times for questioning in the case of arson, violence and vandalism in Balodabazar, the SIT team of Balodabazar police arrested Bhilai Nagar MLA Devendra Yadav on 17 August. The MLA's bail plea was rejected today by CGM Ajay Kumar Khakha. On Monday, the court extended the judicial custody of the MLA till September 17. Till now, MLA Yadav's judicial remand has been extended 4 times.
When he was first produced before the court, the court sent him to judicial custody for three days (20 August). Since then Devendra Yadav is lodged in Raipur Central Jail.
The loss of government property in this incident was estimated to be Rs 12.53 crore. Similarly, 240 government and private vehicles were damaged, out of which 99 vehicles were burnt to ashes by the miscreants. The police have so far arrested 184 people in this case.
