Prayagraj, 02 November (HS). Allahabad High Court has approved the bail of Raj Bahadur Bind, who is serving life imprisonment for 13 years for the crime of murdering a young man by stabbing him in Sarai Inayat police station area.
This order has been given by the division bench of Justice Ashwani Kumar Mishra and Justice Dr. Gautam Chaudhary after listening to Raj Bahadur Bind's advocate and government lawyer.
The Sessions Court has convicted Raj Bahadur Bind, resident of Hajipur village, under sections 302, 504, 506 (2) and 452 of the IPC and section 4/25 of the Arms Act and sentenced him to life imprisonment. He was accused of abusing a youth of the village due to an ongoing enmity and then entered the house and stabbed him several times, resulting in his death.
The arguments in support of bail were that the accused has no criminal history and has been in jail for more than 13 years. It also said that the prosecution's story is not credible as there were multiple wounds on the body of the deceased and according to the doctor the deceased was attacked when he was naked.
The government lawyer has opposed the bail plea but did not deny the fact of the long-term imprisonment of the accused. After the hearing, the court accepted the bail plea due to the long term imprisonment of the accused, the issues raised in the appeal and the accused having no criminal history.
