Whereas the benefits should be given to the petitioner from the date of appointment given to the candidate who got less marks. The court said that after being appointed, the petitioner will be entitled to receive regular salary and other benefits. The single bench of Justice Ganesh Ram Meena gave this order while accepting the petition of Mukesh Kumar Saini.
In the petition, advocate Rampratap Saini told the court that the petitioner had done B.Ed in 2013 after completing BA in 2011. He passed B.Sc from OPJS University from 2013 to 2016. The petition said that he appeared in the REET exam in 2015 and scored more than 75 percent marks. After this, he appeared in the cut off after appearing in Level-2 of Third Grade Teacher Recruitment held on September 11, 2017. Despite this, his B.Sc. marks were not included and he was not given appointment. On the other hand, Additional Advocate General Vigyan Shah, appearing for the state government, said that the marks of the BA degree done before the B.Ed degree of the petitioner can be added and not the marks of B.Sc degree done after the B.Ed. After hearing the arguments of both the parties, the court has asked to give appointment to the petitioner if he comes in the merit on the basis of marks of B.Sc degree done after B.Ed.
