Mumbai: Nagpur bench of Bombay High Court has ordered the early release of notorious gangster-turned-politician Arun Gawli. Mrs. Vinay Joshi and Nya. Vrushali Joshi's bench allowed the criminal petition filed by Arun Gawli. According to a government notification dated 10 January 2006, Gawli filed an application claiming early release.
The hearing on Gawli's petition was completed in the court, but the court reserved its decision. While giving its verdict on this, the court has directed to release Gawli before the term. In this regard, the court has given four weeks time to the jail administration to file its reply. Now it remains to be seen what decision the jail administration takes.
In Mumbai, former Shiv Sena municipal servant Kamlakar Jamsandekar was sentenced to life imprisonment in a murder case. Gawli is currently serving his sentence in Nagpur Central Jail.
According to the government decision of 2006, disabled prisoners who have completed 65 years of age and have served most of their sentence get relief from their punishment. According to this, Arun Gawli has demanded early release from his sentence. After the court's decision, his chances of getting out of jail have increased.
According to a 2006 government circular, a prisoner sentenced to life imprisonment can be released after completing 14 years of his sentence, as can a prisoner above 65 years of age.
However, the government argued that the declaration did not include criminals convicted of MCOCA-like offences. The accused cannot get this benefit under NDPS, TADA, MPDA etc.
Since Gawli was born in 1955, his age is 69 years. He has been in jail for sixteen years since 2007 in the Jamsandekar murder case. According to the Maharashtra Circular of 2006, Gawli has fulfilled both the conditions of exemption. Therefore the court has decided to release him prematurely.
Kamlakar Jamsandekar had a property dispute with a person named Sadashiv Surve of his area. Sadashiv gave betel nut from Gawli's hand. Jamsandekar was shot dead at his home on the evening of 2 March 2007.
