Mumbai: In a blow to CBI, a special court has ordered the release of Rahul Kumar, Joint Commissioner of Central Goods and Services Tax (CGST) of Diburgarh, Assam. The court gave this order considering the allegations of illegal arrest and violation of arrest rules.
Kumar was arrested last week in connection with a case registered against him for illegally detaining Gorgaon businessman Karan Rawal and extorting money from him in August. The CBI arrested Kumar from Diburgarh at 8 pm on October 24 and produced him in a special court in Guwahati the next day. CBI asked for transit remand for Mumbai.
On Saturday, the government side asked for five days' custody. Kumar's lawyer opposed the plea, claiming that the investigating agency had not given the mandatory pre-arrest notice under the new law and had also failed to disclose the reason for the arrest. The reason was explained verbally the next day. Taking into account the defense arguments, the court ordered Kumar's release and said that the CBI had not violated the rules.
