Jaipur, 21 November (HS). The special court for NIA cases has rejected the application of accused Nitin Fauji, Ramveer and Udham Singh, lodged in the high security jail of Ajmer in the Sukhdev Singh Gogamedi murder case. The accused had accused the jail administration of not allowing them to talk to their family members through STD phones and not allowing them to meet them. Presiding Officer Mashroor Alam Khan said in his order that accused Udham Singh is being made to talk to his family members. Whereas in the case of Nitin and Ramveer, no application for meeting the family members has been presented to the jail administration. Apart from this, the phone facility has been closed due to the accused being charged under the Unlawful Activities Prevention Act. In such a situation, the application presented by the accused is rejected.
It was said in the application that the applicants were made to talk to their family members over the phone in the month of August last. After this, neither he was made to talk to his family members on phone nor was he made to meet them. Apart from this, they are also being tortured physically and mentally. Whereas under the Constitution, every accused has the fundamental right to talk and meet his family members. In response, the jail administration said that as per the state government’s order dated December 10, 2019, phone facility is not available to foreign prisoners, prisoners under trial under NSA, Raj.PASA, COFEPOSA, UAPA Act. Apart from this, Udham Singh has been made to meet his family members on his application and due to Nitin and Ramveer assaulting their fellow prisoners, a fifteen day ban has been imposed on them from meeting on September 17, 2024. Apart from this, no application for meeting has been made from his side. After hearing the arguments of both the parties, the court has rejected the application. It is noteworthy that on December 5, 2023, Gogamedi was shot dead by Rohit and Nitin after entering his house.
