Jaipur, 6 November (HS). Additional Sessions Court No. 4 of the district has rejected the application filed for cancellation of anticipatory bail granted to Chief Minister Bhajanlal Sharma in the Gopalgarh riot case. Sanwarmal Choudhary had submitted this application alleging that he had disregarded the condition of anticipatory bail and gone abroad without the permission of the court.
The court said in its order that it is not proved in the case that the applicant has any interest in the case or that he is the one who filed the FIR. He is neither a victim in the case nor has he suffered any loss or interest. In such a situation, he has no right to present the application. Therefore the application is rejected.
It was said in the application that CBI had registered an FIR in the Gopalgarh riot case and presented the charge sheet many years ago. In this FIR, Bhajanlal Sharma had presented an anticipatory bail application. Which the court accepted on September 10, 2013 and granted conditional anticipatory bail. A condition was imposed in the anticipatory bail order that Bhajanlal would not leave the country without the permission of the court. It was said in the application that Bhajanlal Sharma disregarded the condition of bail and went abroad without permission. It was said in the application that Bhajan Lal has now become the CM of the state and there is a BJP government at the center also. It was the responsibility of the prosecution to bring out the fact of disobeying the court order, but no action was taken by them. In such a situation, the anticipatory bail should be canceled and they should be taken into custody. Opposing the application, advocate Ashwini Bohra, appearing for the CM, said that the person filing the application is a private person and none of his rights have been violated. Therefore the application should be rejected. After hearing the arguments of both the sides, the court has rejected the application. On the other hand, the court has also rejected the application of former MLAs Zahida Khan and Anita Gurjar, in which they had requested to remove the condition of not going abroad without permission while granting anticipatory bail.
It is noteworthy that after the violence in Gopalgarh in 2011, Bhajanlal Sharma, Zahida Khan and others had reached the local police station. To avoid arrest in the FIR lodged by the CBI in the case, Zahida Khan, Anita Gurjar, Jamshed Khan, Pramod Sharma, Jawahar Singh Bedam, Kesari Singh, Girdhari Tiwari and Bhajan Lal Sharma, among others, submitted anticipatory bail applications in the year 2013. Was. On which, while hearing jointly, the court had given him the benefit of anticipatory bail.
