There was uproar on the third day of the Jammu and Kashmir Assembly after Deputy Chief Minister Surinder Chaudhary moved a resolution demanding the restoration of Article 370. After much uproar, this proposal was passed in the assembly. Leader of Opposition Sunil Sharma strongly opposed this move and raised questions on the government saying how the resolution was passed when Viceroy Pal's speech was under discussion. Independent MLAs Sheikh Khurshid and Shabbir Kulle, PC president Sajjad Lone and three PDP MLAs supported the resolution.
The Jammu and Kashmir Assembly on Wednesday passed a historic resolution demanding restoration of the state's erstwhile special status under Article 370, which was abrogated by the Center in August 2019. On the third day of the current session, the resolution moved by National Conference (NC) leader and Deputy Chief Minister Surinder Kumar Choudhary received the support of the ruling party despite strong opposition from opposition BJP members.
What was said in the proposal?
The resolution said that this assembly reaffirms the importance of special status and constitutional guarantees. Which expresses concern over the protection of identity, culture and rights of the people of Jammu and Kashmir and its unilateral abolition. This Assembly calls upon the Government of India along with the elected representatives to formulate a constitutional mechanism for the restoration of special status, constitutional guarantees and provisions to the people of Jammu and Kashmir. The Assembly emphasizes that any process of restoration will safeguard both national unity and the legitimate aspirations of the people of Jammu and Kashmir.
Anti-national agenda of NC-BJP
BJP has termed this proposal of National Conference as an anti-national agenda. The saffron party created a ruckus in the assembly and its MLAs raised slogans of August 5 Zindabad. He said that where Mukherjee was sacrificed, that Kashmir is ours. Describing Article 370 as final, BJP leader Sham Lal Sharma said that emotional blackmailing from Sheikh Abdullah to Omar Abdullah is routine in the National Conference.
In August 2019, the Narendra Modi government at the Center took a historic decision by removing Article 370 of the Constitution. This provision granted special autonomous status to Jammu and Kashmir, giving the territory significant control over its internal affairs, including its constitution and flag, except defence, communications and foreign affairs. With this constitutional change, the state was divided into two separate union territories, forming Jammu and Kashmir and Ladakh.
The opposition protested
The move to remove Article 370 was opposed by the National Conference, People's Democratic Party (PDP) and other regional parties, who argued that the decision weakened the autonomy and identity of the region. On December 11 last year, a five-judge Constitution bench of the Supreme Court upheld the decision and directed to hold elections in the region by September 2024 and restore statehood as soon as possible.
