Maharashtra’s Palghar-based Motor Accident Claims Tribunal (MACT) has ordered a compensation of Rs 1.06 crore to an injured person in a 2017 case. The 31-year-old man was paralyzed in a road accident on the Mumbai-Ahmedabad highway in 2017. The victim, Rishabh Vijay Kumar Chopra, is a hotel management alumnus. MACT member A.R. Rahane has directed the owner of the truck that hit Rishabh’s car and its insurance company ‘New India Assurance Company Limited’ to jointly pay Rs 1.06 crore to the victim.
The accident took place on December 31, 2017, while traveling from Vapi to Mumbai.
The Motor Accident Claims Tribunal has also directed the truck owner and New India Assurance to pay 6 percent annual interest on this amount from the date of filing of the application. According to the claim application, Rishabh, a hotel management student, was traveling from Vapi in Gujarat to Mumbai with his parents on December 31, 2017. His father was driving at that time. Meanwhile, a speeding truck hit his car near Haloli village. The application states that due to the collision the car overturned three to four times and fell on the other side of the road.

In this accident, Rishabh’s mother died on the spot, while he was seriously injured and paralyzed from the waist down. Due to this, he became permanently disabled up to 70 percent and has been bedridden since then. The insurance company contested the claim, alleging that the accident was due to the negligence of the victim’s father. The company also raised questions on Rishabh’s future earning potential and medical expenses.

The tribunal said the police have filed a charge sheet against the truck driver only for rash and negligent driving. “The filing of the charge sheet makes it prima facie clear that the truck driver was driving recklessly and at high speed,” the tribunal said. The Motor Accident Claims Tribunal has directed the defendants to deposit the entire amount within two months.
