Rajasthan High Court has asked the Advocate General to present his case in the court regarding giving reservation to specially abled people in promotion in the government services of the state. The court has asked the Advocate General to cooperate with the court in deciding when the provision of reservation for specially abled people in promotion should be implemented. The division bench of Justice Pankaj Bhandari and Justice Shubha Mehta gave this order while hearing the petition filed by Manoj Kumar Sharma.
The petition said that the Specially Abled People Rights Act came into force in 2016. Its rules were made in the year 2018. In these, no provision was made regarding reservation in promotion for disabled employees. Meanwhile, while hearing a petition, the Supreme Court passed an order on June 30, 2016, asking the Central Government and State Governments to make provision for reservation in promotion for the disabled. It was said in the petition that the state government made a provision for giving reservation in promotion to specially abled employees by amending the Rights of Special Persons Act in the year 2021. On behalf of the petitioner, it was said that the Supreme Court had ordered in June 2016 to give reservation in promotion to such employees. Therefore, instead of implementing this provision from the year 2021, it should be implemented from June 2016 itself. On this the court said that this is a matter related to an important point. In such a situation, the Advocate General should present his side in this regard.
