Adil Bazai’s membership reinstated in Pakistan National Assembly, Election Commission’s decision suspended

Islamabad, 09 December (HIST). A three-member bench of the Supreme Court of Pakistan on Monday reinstated Adil Bazai’s membership in the National Assembly, suspending the decision of the Election Commission of Pakistan (ECP). This bench headed by Justice Mansoor Ali Shah included Justice Akil Abbasi and Justice Ayesha A Malik. The court will hold the next hearing on December 12.

Bazai was accused of disregarding the party’s policy by supporting the opposition during the passage of the 26th Constitutional Amendment. After this, the Election Commission of Pakistan on November 21, on the request of National Assembly Speaker Sardar Ayaz Sadiq, suspended Quetta MLA Bazai. Was declared ineligible. After this Bajai had approached the Supreme Court.

According to the petitioner’s lawyer Taimur Aslam, the Commission had removed Bajai from the post under Article 63-A. He argued that the Election Commission neither properly reviewed the facts nor called Bajai for investigation. Aslam argued that the issue of Bajai’s affidavit was already pending in a civil court, raising questions over the ECP’s jurisdiction in the matter.
