According to the Supreme Court decision, judges cannot be discriminated against on the basis of source of appointment.

'No discrimination in pay or other benefits'

The bench said, High Courts are constitutional institutions and their constitutional status is recognized by Article 216. In such a situation this article does not discriminate in the manner of recruitment of High Court judges. After appointment all judges enjoy equal status. They cannot be discriminated against in terms of salary or other benefits.

Patna High Court judges knocked on the door of SC

The Supreme Court was hearing the matter related to the pending salary and pension of the judges of Patna High Court. Some sitting judges of the High Court approached the Supreme Court. Because their salaries were not released due to closure of General Provident Fund (GPF) accounts. Confusion arose when NPS contributions were transferred to GPF accounts given to high court judges after their appointment.
