Abuse of daughter-in-law against mother-in-law; Elderly women unsafe despite Supreme Court order

Supreme Court: In a survey among elderly women, 16% revealed that they had faced some form of abuse from their family members, with physical abuse being one of the top types of abuse. While 66% of elderly women believe elder abuse is prevalent in society, among those who have experienced abuse, only 16% of women reported abuse. Abuse mainly took the form of physical abuse (52%), verbal abuse (51%), disrespect (60%), neglect (51%) and financial abuse (25%). Daughter-in-laws, spouses and other relatives were also abusers.

Widow Nalini Mahendra Shah, a senior citizen living in Juhu, lodged a complaint at Juhu police station for trying to enter the Juhu house of her daughter-in-law Sheetal Shah despite orders from various courts, including the Supreme Court. The incident pertains to a senior citizen who filed an application before the Senior Citizens Tribunal and was subsequently ordered to evict his son and daughter-in-law on 16/8/2.

Sun challenged this order in the Bombay High Court and the Bombay High Court confirmed the tribunal's order. Sheetal Shah challenged the High Court order in the Supreme Court and the Supreme Court directed her to first comply with the Tribunal order and as per the direction of the Supreme Court, she was provided alternative accommodation in a bungalow in Lonavala. Later the Supreme Court rejected Sheetal's petition and confirmed the tribunal's order.

However, on 5/2/2024, Sheetal along with some goons tried to enter the Juhu House and misled the Juhu Police officials and she again tried to forcefully enter the property on 6/2/2024. Under this, Nalini Shah has taken contempt action against Sheetal and a notice has been issued to Sheetal Shah.

The incident has raised serious doubts about the welfare and safety of senior citizens, who are facing threats and intimidation from litigants despite getting relief from the country's High Court in the last stages of their lives and after a long legal battle. Are. Like Sheetal Shah, who completely disregarded court orders at the behest of some very influential people.

Poor family relationships are highly stigmatized in our society. Elder abuse is becoming a serious problem. Many cases go unreported because fathers are afraid or unable to tell the police, friends or family about the violence. Victims must decide whether to report their injuries or continue to be abused by someone they depend on or care about.
