The Supreme Court directed the state government: The Supreme Court has directed all state governments and union territories to implement Section 136A of the Motor Vehicles Act. Which gives the administration the power to electronically monitor the speed of vehicles. The court directed Delhi, West Bengal, Maharashtra, Tamil Nadu, Karnataka and Kerala to report compliance with Section 136A and Rule 167A of the Motor Vehicles Act. This order was issued to ensure road safety by taking action against vehicles violating the rules on highways.
Action can be taken against those who violate the rules
Rule 167A lays down detailed provisions for placement of electronic devices, including speed cameras, CCTV cameras, speed guns, body-worn cameras, dashboard cameras, automatic number plate recognition, weigh-in machines and similar technologies. State governments will have to install electronic devices at high-risk and high-traffic locations on national and state highways and at important junctions in major cities with a population of more than one million, including the 132 cities specified in the rule.
The court will consider the report on December 11 and issue similar directions to other state governments. A concept paper has been prepared to effectively implement and enforce section 136A of the Motor Vehicles Act across the country. If all the recommendations made in the concept paper are implemented, the provisions of section 163A (compensation to victim for permanent disability or death due to accident by vehicle) will not be implemented for a few years now.
Terming Section 136 as a new provision implemented in 2021, the court said that this will help the state governments to ensure road etiquette and compliance with the Motor Vehicles Act. With the implementation of Section 136A, the state administration will be able to obtain information about vehicles and persons violating the Motor Vehicles Act and take action against them accordingly.
