Prayagraj, 04 March (HS). Allahabad High Court has given relief to the petitioner from Moradabad, who was kept in custody under the National Security Act, and ordered his release. Besides, the December 3 order of keeping him in custody under the Act was also cancelled.
The court said that on the basis of an incident of murder, there was no need to keep the petitioner in custody to maintain public order. This order has been given by the division bench of Justice Siddharth Verma and Justice Ram Manohar Narayan Mishra while accepting the habeas corpus petition filed on behalf of Kamalveer Singh.
The petitioner was accused of the murder of Anuj Chaudhary in Moradabad. His name came up in the investigation. After this, action was taken against him under the Gangster Act. On the basis of the police report, the DM took action against the petitioner under the National Security Act on 03 December 2023 and took him into custody. The petitioner approached the High Court against this. It was said on behalf of the petitioner that he was kept in illegal custody. He was not given any legal aid. When he applied for his release from custody, it was also rejected. Apart from this, his name is not mentioned in the FIR. Later he was implicated in a conspiracy.
