Jharkhand High Court sought reply in the case of DSPMU's third class employee | News India

Ranchi, 21 August (HS). A petition was heard in Jharkhand High Court on Wednesday against the excessive increase in the salary of the third class employee of Dr. Shyama Prasad Mukherjee University (DSPMU) and the letter for recovery of the payment amount. In this case, the court has sought a reply from the Finance Department and Human Resources Department and Dr. Shyama Prasad Mukherjee University within four weeks.

During the hearing, the court was told on behalf of the petitioner Manoj Kido that in a similar case, the High Court had stayed the letter issued by Shyama Prasad Mukherjee University regarding the recovery of excessive salary of the employees, but again the university has started the recovery process on 17 August and issued a show cause notice to them, whereas in the case of Manoj Kumar and 37 other university employees, the High Court had asked the petitioner to give his representation to Shyama Prasad Mukherjee University by 22 August and the university to reconsider it. Till then, the university's order regarding excessive salary recovery was stayed and the petition was executed, but before giving the representation by 22 August, the recovery process has been started by issuing a show cause notice to the petitioner, which is a contempt of the earlier order of the High Court.

Dr. Shyama Prasad Mukherjee University, while issuing a letter regarding the return of excess salary payment to class III and IV employees, had said that the university had paid them excess salary under the 7th Pay Commission. Therefore, the excess salary paid to them will have to be returned. Advocate Rajesh Kumar argued on behalf of the petitioner. Advocate Rajesh Kumar told the court that Shyama Prasad Mukherjee University has issued a letter regarding payment of Rs 13 lakh excess to the applicant under the 7th Pay Commission. It has been said that he has been paid excess under the 7th Pay Commission, which will be recovered. He told the court that this order of the university is wrong.
