Prayagraj, 07 August (HS). Allahabad High Court said that the bar and bench are the two eyes of justice. No one can be allowed to misuse the judicial process. The court said that the looting of government money by implicating people in false cases cannot be ignored. In such a situation, the court cannot remain a mute spectator. Strict action should be taken. The court said that the truth should be exposed and the black sheep should be caught.

A petition filed in the High Court seeking speedy disposal of a case revealed that a gang of some lawyers, who are engaged in some other business instead of practising law, is operating in Prayagraj. They implicate innocent people in false criminal cases under the SC-ST Act by involving women and then divide the amount given to the victim by the government after the charge sheet is filed.

The police was investigating when after this revelation, Justice Dr. Gautam Chaudhary ordered a preliminary investigation by the CBI to find out the truth. Some SIT investigations were also conducted. The court has declared the petition meaningless after the CBI filed a closure report in the case registered by Nikki Devi in Daraganj police station against advocate Bhupendra Pandey.

On the other hand, the CBI filed an application in the special court in Lucknow to prosecute petitioner Nikki Devi, advocate Vinod Shankar Tripathi and Sudhakar Mishra under Section 120B and Section 211 of the Indian Penal Code. The court has sealed the preliminary report of the CBI investigating this case and placed it before the Registrar General and ordered the SIT to investigate eight cases. A copy of the order has been asked to be sent to IG SIT Lucknow.

Advocate Shailesh Mishra, CBI advocate Gyan Prakash and opposition Bhupendra Pandey argued on the petition. Later, all the lawyers submitted applications with disclosures. 51 criminal cases were disclosed. Most of which are registered in Mauaima.

It was told that a gang of lawyers, with the help of a woman, files a false FIR under SC-ST Act. After the chargesheet is filed, they divide the amount given to the victim by the government. Lawyers along with many others have been implicated in false cases. Bhupendra Pandey was implicated in a false rape case. Seeing the seriousness of the allegations, the court handed over the preliminary investigation to the CBI in the interest of justice. Which has brought the gang in the dock.

When the CBI started investigating 46 cases, it was found that they were only 38 cases. Cases registered in other police stations including Sarai Inayat also came up. The court made full disclosure in its 108 page judgment and said that those who misuse the judicial process should not be spared. At present, the SIT will investigate eight cases. In those cases where chargesheet has been filed, the concerned district judges have been asked to complete the trial.
