Life imprisonment: 40 years ago, a small fight broke out between children over mangoes in a village in Uttar Pradesh. In this fight, a villager was beaten to death. A case has been registered against three people.
Now, 40 years later, the Supreme Court has reduced his life sentence to seven years. In 1984, a case was registered against three people for killing a villager by hitting him on the head with a stick.
A bench of Justices Sudhanshu Dhulia and Ahsanuddin Amanullah said that considering the totality of the facts and circumstances of the case, the nature of injuries sustained by the deceased and the nature of the weapon used, “we are inclined to accept it.” In fact, this is not a case of murder but of culpable homicide not amounting to murder.
The bench said that the statements of all the eyewitnesses in the case showed that this was not a case of premeditated murder. The bench said this in its order of July 24, which has been recently uploaded on the Supreme Court website. The bench converted the sentence of life imprisonment of all the appellants to seven years of rigorous imprisonment.
