Prayagraj, 06 August (HS). The High Court accepted for hearing the election petition of BJP-Apna Dal (S) joint candidate Rinki Singh, who came second against Samajwadi Party candidate Chhote Lal Kharwar, who won from Robertsganj (Sonbhadra) Lok Sabha seat in the last Lok Sabha elections, and passed an order to issue notice to the opposition.
The above order was passed by a single bench of Justice Shekhar B. Saraf of the High Court after hearing the arguments of Rinki Singh's advocate, senior advocate Anoop Trivedi and Advocate Abhishek Kumar Choubey, National President of Law Forum.
Advocate Abhishek Choubey argued that the affidavit given by Samajwadi Party candidate Chhote Lal Kharwar contained false facts regarding caste certificate, property, income, educational qualification, hiding the number of dependents from the first wife and other material information. The court gave its verdict after hearing the arguments given by Abhishek Choubey on the above various points. During his arguments, Rinki Singh's lawyer said that the above false facts given by the Samajwadi Party candidate in his affidavit fall under corrupt conduct under section 100 (1) B and (D) of the Representation of the People Act. Therefore, on this basis, the court should cancel the election of the opponent and direct the petitioner Rinki Singh to be declared the winner.
During the hearing, the state secretary of Vidhi Manch Virendra Chaudhary, Brijesh Singh Patel, Sanjay Tripathi, Rajesh Patel, Rajkumar Mishra, Deepmala Patel, Ashutosh Singh Patel, Deepak Kesarwani, Prashant Mishra and other state officials and advocates of Vidhi Manch were present.
