New Delhi, 6 August (HS). The Supreme Court has reserved the decision while hearing the bail plea of Delhi Excise Scam accused and former Deputy Chief Minister of Delhi Manish Sisodia. The bench headed by Justice BR Gavai reserved the decision after hearing the arguments of both the sides.
During the hearing, ASG SV Raju said that he is asking for copies of those documents which have not been relied upon by the prosecution. They are not relevant to framing of charges. This is the reason for the delay. Justice Vishwanath asked Raju if he has challenged the order given to give those documents. The court asked what is the time for inspection of the documents. Then Raju said that inspection can be done from 10 am to 6 pm. We have also challenged those orders which are pending in the High Court. There is also a stay on the release of some documents. Therefore, the delay is entirely due to the petitioner. Therefore, he cannot be allowed to take advantage of the delay caused by him.
During the hearing, Justice KV Vishwanathan said that there are 493 witnesses, when can their statements be recorded. The court asked when will the charges be framed. Then Raju said that when the inspection of documents by the petitioner has been completed, then the charges will be framed. Justice Gavai asked that you yourself had said that inspection is not required. During the hearing, Singhvi, who appeared for Sisodia, said that in this case, the minimum sentence is three years and the maximum is seven years. He has already served half of the minimum sentence. The court told ED and CBI that in every bail case, you say the same thing that evidence can be tampered with.
The Supreme Court, while hearing the case on July 16, had issued notice to the CBI and ED. The bench headed by Justice BR Gavai ordered the next hearing of the case on July 29. Sisodia has challenged the Delhi High Court's order of refusing bail on May 21. The Delhi High Court had said that Sisodia misused his position. He also destroyed electronic evidence of the scam. He can come out and influence the evidence and witnesses.
