Refusal to stay the order to demolish the Civil Lines house of national pistol shooting coach Samaresh Jung

New Delhi, 05 August (HS). Delhi High Court has refused to stay the order to demolish the Civil Lines house of national pistol shooting coach Samaresh Jung. Justice Sanjeev Narula's bench said that this house was leased to Samaresh Jung's family, so the petitioner has no legal right over this house.

The petition was filed by Samar Jung's brother Sameer Jung. The petition challenged the order of March 01 in which all the residents living in 32 acres of Khyber Pass Market were issued a notice to vacate the land, terming it as unauthorized occupation. Samaresh Jung was also living in the same house where his family members were allowed to live as sub-tenants about 60-70 years ago.

During the hearing, advocates Rohit Yadav and Sahil Siddiqui, appearing on behalf of the petitioner, told the court that the petitioner was not given any opportunity to present his side before issuing this notice. He said that Samaresh Jung has won many medals in sports for the country and he is being removed. On this, the court said that this sounds very bad but the facts are different. Action has already started there and some houses have also been demolished. In such a situation, it will be difficult to issue any preventive order.

During the hearing, the lawyer representing the Land and Development Office said that the shooting coach must have done something for the country but this is a public land and no restraining order can be issued on it. The petitioner cannot claim any legal right on this land. Other houses have also been demolished there.
