NDA leaders will seek review in Supreme Court

SC ST Reservation Sub-Quota Creamy Layer: Union Minister Chirag Paswan has objected to the Supreme Court's decision to create a creamy layer in the Scheduled Caste (SC) and Scheduled Tribe (ST) categories. Chirag's Lok Janshakti Party (Ram Vilas) has decided to file a review petition in the Supreme Court. Chirag Paswan said, “We cannot comment on the Supreme Court's decision, but our party has objections to this issue.” Due to this, we are going to file a petition in the Supreme Court demanding reconsideration. Two days ago also, Chirag Paswan's party LJP (R) had given a statement opposing the creation of sub-categories in SC ST reservation and bringing cremation.

What did Chirag Paswan say?

Union Food Minister and LGP (R) President Chirag Paswan on Saturday (August 3) attended a food processing industry event at Maurya Hotel in Patna. Later, while talking to the media, he said, 'As far as SC is concerned. There are some castes whose basis is untouchability. Due to this, provision of bringing the quota of reserve inside this reserve cannot be made. Along with this, the provision of crematorium cannot be implemented. Chirag further said that even today the affluent people of Dalit society are discriminated against on the basis of untouchability. Even if the veterans of the Dalit community visit the temple, the temple is washed with Ganga water. This shows that even today there is discrimination on the basis of untouchability.'

What was the Supreme Court's decision?

In a historic decision on Thursday, the Supreme Court gave constitutional power to the state governments to create sub-categories to give the benefit of reservation to the most backward castes among the Scheduled Castes and Tribes. Along with this, the Supreme Court has given consent to the states to create quotas within quotas for the upliftment of socially and educationally backward castes. Now the state assemblies can make laws to create sub-categories within SC-ST. However, the Supreme Court has directed the states to exclude Crimeans from this reservation. A seven-judge Constitution Bench headed by Chief Justice Dhananjay Chandrachud gave this verdict by a majority of 6:1. Single judge Bela Trivedi expressed a dissenting opinion in this bench.

How will quota be given within quota?

Reservation is provided in educational institutions and government jobs for socially and educationally backward Scheduled Castes and Scheduled Tribes. However, with the Supreme Court order on Thursday, there will be quota within reservation, as per the existing system, 15 per cent reservation is given to Scheduled Castes, 7.5 per cent to Scheduled Tribes and 27 per cent to Other Backward Classes (OBCs) and 10 per cent to economically backward classes. Now, after this decision of the Supreme Court, reservation will be given to the most backward and needy castes of Scheduled Castes by creating a sub-category within the 15 per cent reservation of Scheduled Castes. That is, it will be ensured that even among the backward and needy classes getting the benefit of reservation, the neglected castes will get the benefit of reservation under the sub-category.
