While ordering the mother to allow her four-year-old granddaughter, who lives in Germany, to talk to her grandparents through video calls every day, the Delhi High Court said that grandparents have the same right over their grandchildren as parents or other relatives have over their children. This cannot be ignored.
In the case presented in the court, the mother went to Germany with her four-year-old daughter. The father filed a habeas corpus writ to bring the daughter before the court. The bench of Justice Pratibha Singh and Justice Amit Verma ruled in favor of the father and said that he can go to Germany to meet his daughter. Also, the mother was ordered to make the granddaughter talk to grandparents through video call every day. Also, whenever a mother comes to India with her daughter, the daughter will spend time with her father and grandparents. The bench said that since the girl is young, she should be kept with her mother. The mother was also directed not to keep the child away from her father or grandparents.
The High Court said that grandparents have a closer relationship with their grandchildren than their children. Just as parents cannot stay away from their children, grandparents also cannot stay away from their grandchildren. Because of this, their rights cannot be ignored. The High Court bench told the mother not to remove the father's name from the child's documents. The child can live with the mother but his nationality should be Indian because his father is a citizen of India. A father can also go to Germany to meet his daughter whenever he wants.
