Wife who separates from husband without reason is not entitled to maintenance: Jharkhand High Court

Ranchi, 29 February (HS). Jharkhand High Court has said in one of its orders that a wife who lives separately from her husband without any valid reason is not entitled to maintenance. The High Court has given this order while hearing the criminal revision of Amit Kumar Kachhap, resident of Jamshedpur.

The Family Court of Ranchi Civil Court had ordered that Amit Kumar Kachhap should pay Rs 15 thousand per month as maintenance to his wife Sangeeta Toppo. On this, the family court passed an order in her favor and fixed a maintenance allowance of Rs 15,000 every month from October 30, 2017 and asked the husband to pay this amount. Husband Amit Kumar Kachhap had filed a criminal revision petition in the High Court against this decision of the Family Court. He said that after marriage, his wife stayed at his house in Jamshedpur for a week. After this she went to Ranchi in the name of serving her family for a few days. She had said that she would return within 15 days, but despite repeated requests she did not return. After which the court of Justice Subhash Chand concluded that there was a lack of proper justification for the wife's separation from her husband.

Sangeeta Toppo had alleged in the case filed against her husband Amit Kumar Kachhap in the family court of Ranchi that after marriage as per tribal customs in 2014, when she went to her in-laws' house, they started demanding dowry including car, fridge and LED TV from her. happened.

She claimed that her husband and his family used to put pressure on her for this. Her husband neglected her on small matters and often abused her while under the influence of alcohol. She also accused her husband of having an extramarital affair with a woman. He had claimed Rs 50 thousand per month for maintenance.
